Why the position sits where it does

The line Australian tax law draws is between a hobby and a business. A recreational punter is not running an enterprise: the outcome turns on chance, there is no system of books and records behind it, no attempt to make the activity repeatable and profitable, and no commercial scale. Income tax follows that reasoning, so an entertainment win is not income and an entertainment loss is not a business expense.

Offshore accounts, large withdrawals and your bank

What the law says about playing online, which is a separate question

Tax and legality get mixed together constantly, and they are different subjects. The Interactive Gambling Act 2001 prohibits the supply of online casino games, pokies included, to a person physically in Australia without a licence.
